Security Deposit

A security deposit is money that a tenant pays to a landlord to cover damage or loss of the property. This money is usually returned after a lease is completed.

In addition to the security deposit, a rental application needs to specify how much rent is due and how it is to be paid (money order, cashier’s check or electronically). It also need to have details on utilities, fees and late fees.

When it comes to security deposits, each state has different laws. However, in most states a landlord is not allowed to use an applicant’s security deposit against them.

Landlord may use a portion of the Security Deposit to pay delinquent Rent or other charges, cure any defaults of Tenant, or compensate Landlord for any loss or damage that Landlord suffers because of such failure of Tenant to perform its obligations under this Lease. If Landlord uses such a portion of the Security Deposit, Tenant shall restore it to its original amount within ten (10) days following written notice from Landlord in the manner directed by Landlord in such notice.
